Chinese Patent Law Faces Its Third Round Revision

According to the State Intellectual Property Office (SIPO), China’s Patent Law will have its third round changes to fix the patent system and meet the challenges after China joined the WTO.

The sections that are likely to be revised will include how to simplify patent application and examination procedures, whether to adopt international standards in granting patents, and how to improve patent protection and infringement judgment standards. Establish a specific court to handle patent or intellectual property right (IPR) lawsuits is also a part of the proposal.

Tian Lipu, commissioner of the State Intellectual Property Office (SIPO) said the amendment will be an important part of the national IPR strategy which will cover all aspects of IPR, including patent, trademarks and copyrights.

Tian said research on the amendment has begun early this year, and the National People’s Congress will announce the revised sections next year.

I read your blog and the official announcement at SIPO.

They are talking about a lot of strategies:
“The IP strategy is correlated with the Strategy of Developing the Country by Relying on Science and Education, the Sustainable Development Strategy, the Strategy of Reinvigorating China through Human Resource Development, etc. All of the above-mentioned national strategies have a common goal: building a well-off society, making contributions for China’s renaissance. The strategy-making work should be directed by Deng Xiaoping Theory and the important conceptions of the “Three Representatives”. At the same time, it should follow the following basic principles, such as government-oriented, innovation-based, coordination-emphasized, etc.”

Now I am going to find out what the strategies mean and the conceptions of the Three Representatives. If you know already please let me know. If not, visit
